Mr. Nikain is a Managing Director in the FACS Construction Consulting practice and is responsible for the growth of its construction claims and dispute resolution services throughout the United States and abroad.
A recognized expert in dispute resolution, for numerous engagements Mr. Nikain has performed analyses and testified on claims of diverse nature, complexity, and size. He has experience performing extensive evaluations involving schedule delay, disruption, acceleration, and early completion; resource productivity and inefficiency; differing site conditions; quality and workmanship; change orders; causation and responsibility; damages quantification; design process; and management performance and other issues with claim values ranging from the millions to well over a billion dollars.
He also has extensive experience in claims related negotiations, ADRs, and mediations as well as providing expert testimony in courts and arbitrations both nationally and internationally including AAA, ICC, and other formal legal proceedings.
Mr. Nikain's analyses and audits of project and executive management, performance, and effectiveness have been provided to a variety of entities, including multinational corporations and public/quasi-public agencies. Clients have included owners, contractors, project teams, and other construction and engineering groups across industries such as: petrochemical, oil/gas, power and utility, rail/transportation, manufacturing, hospitality, and education.
Mr. Nikain's risk management expertise includes project and overall risk profiling, industry benchmarking and best practices assessments, risk management training, risk auditing, and claims prevention and management. He has led engagement teams in detailed analyses of procurement strategy, contracting approaches, cost risk assessments, schedule risk identifications, and development of risk mitigation plans and strategies.
Mr. Nikain's engagement experience also includes evaluations associated with piping and underground issues; hazardous decommissioning and decontaminations; asbestos abatement programs and claims review; pre design work; construction management; procurement and bidding practices; contract negotiations, startups and operations; project close out; and commissioning, testing, and maintenance activities.
Mr. Nikain has a Bachelor of Science in Civil Engineering from Rutgers University and a Master of Science in Civil Engineering, Structures from Rutgers University. Mr. Nikain also has Executive Management Training, Management Essentials from the Stern School of Business, New York University and Executive Education, Managing Conflict and Creating Consensus from the Darden School of Business, University of Virginia. He is a professional Engineer in over 20 U.S. states, Canada, and Australia as well as a Certified Project Management Professional, a Certified Forensic Claims Consultant and a Planning and Scheduling Professional. Furthermore, Mr. Nikain serves as an Adjunct Professor at the Civil Engineering and Engineering Mechanics Department of Columbia University.
