Mass tort litigation has become a part of the business landscape. Many of these lawsuits have helped right wrongs, provided funds for injured or otherwise affected victims and their families, and held negligent parties accountable for their actions. Yet the proliferation of mass torts – some warranted, others not – has also created numerous negative side effects. Courts are backlogged. Scores of companies – some with no direct involvement in the cause of this litigation – have been forced to file for bankruptcy. Jobs have been lost.
In today’s legal environment, virtually all organizations are at risk for mass tort lawsuits. These suits can be triggered by a broad range of circumstances, from product liability claims to large business antitrust claims. One element all of these cases have in common is the adverse effect they can have on a company’s operations and bottom line.
